Distance Selling Agreement

1. Parties
Buyer: the person placing the order. Seller: the store selling the product. Intermediary: Trendyada Marketplace Ltd. · Girne, Northern Cyprus — operating this marketplace.
2. We are a marketplace, not the seller
The sales contract is formed between the buyer and the store. If your cart contains products from several stores, each store is a separate sale: separate parcels, separate documents, separate returns.
3. Price and tax
The price you see is the price you pay. Prices include VAT; tax is extracted from the price, not added on top. Shipping, and any bulky-item surcharge, are shown as separate lines. For products priced in foreign currency the rate is fixed at the moment of order.
4. Payment
Card details are never sent to us. Unpaid bank-transfer orders are reminded and then cancelled after the period defined in the panel, releasing the stock.
5. Delivery
Each store ships its own parcel, so items from different stores may arrive at different times. Pre-order items carry no guaranteed date. Inspect the parcel on delivery; if damaged, do not accept it without a report.
6. Right of withdrawal
The buyer may withdraw without giving a reason within the period provided by the applicable law, through Return request in the account.
This right does not depend on the store's approval. Where a withdrawal notice is given in time for goods that are not excepted, the store may not refuse it; the store only assesses whether the goods fall within an exception and the condition in which they are returned.
Exceptions include personalised goods, perishables, items unsuitable for return once opened for reasons of health or hygiene, items that become mixed with others after opening, and digital content.
Return shipping is borne by the buyer where the right of withdrawal is exercised, and by the store where the goods are faulty, incomplete or not what was ordered.
7. Returns and cancellation
Two distinct situations, and they are not the same:
- Statutory withdrawal: a request made in time for goods that are not excepted must be accepted. The price is refunded within the period provided by law after the goods reach the store.
- The store's own returns policy: requests outside that period, or for excepted goods, are subject to the store's policy and are decided by the store.
Refunds are always made through the original payment method and are issued manually. If a store leaves a statutory withdrawal request unanswered or refuses it, the marketplace steps in via destek@trendyada.com. Orders that have not yet been dispatched can be cancelled from the account.
8. Governing law
The law of the Turkish Republic of Northern Cyprus applies.
9. Record
The time of acceptance, the document version, your IP address and browser are recorded.
10. Force majeure
Where obligations cannot be performed because of events beyond a party's control — natural disaster, fire, epidemic, war, declared mobilisation, strike, an order of a public authority, or a general failure of electricity or internet infrastructure — that party is not in default for the duration.
If the event lasts more than thirty days, either party may terminate without compensation. Sums already collected from the buyer for goods not delivered are refunded; force majeure is not a ground for withholding a price already paid.
11. Severability
If a provision of this agreement is held invalid or unenforceable by a competent authority, only that provision falls away and the rest remains in force.
The rights consumer law gives the buyer cannot be limited by this agreement. Where a provision conflicts with the law to the consumer's detriment, the law applies.
